Marguerite program
1. The Marguerite program, hereinafter referred to as “Marguerite,” is offered by 9020-5758 Québec Inc., doing business as Avril Supermarché Santé (Québec enterprise number 1176634682), a legal entity duly incorporated under the Business Corporations Act (Québec), hereinafter referred to as “Avril Supermarché Santé,” whose head office is located at 11 rue Évangéline, Granby, QC, J2G 6N3, Canada, whose telephone number is 1 (844) 375-6446, and whose email address is [email protected].
2. A transaction, hereinafter referred to as a “Transaction,” includes the details of purchases made by a customer at an Avril Supermarché Santé store or on the Avril.ca website
3. A member, hereinafter referred to as a “Member,” is an individual who has signed up for Marguerite and whose membership has not been cancelled.
4. Marguerite includes, but is not limited to, all communications, offers, and rewards that a Member may receive and earn.
5. This agreement is between Avril Supermarché Santé and the Member whose contact details are those they provided on the registration form. A confirmation email containing a copy of this agreement will be sent to the email address provided by the Member at the time of registration.
6. The Member agrees to comply with the Avril Supermarché Santé privacy policy, available online at avril.ca/security-and-privacy, hereinafter referred to as the “Policy.” By accepting this agreement, the Member acknowledges having read the Policy.
7. This agreement and the Marguerite Policy constitute the entire agreement between the Member and Avril Supermarché Santé and govern the Member’s use of Marguerite, including the ability to earn and redeem “Avril Dollars” and rewards, and supersede all prior and contemporaneous agreements, communications, and proposals, whether oral or written.
8. This agreement is entered into on the date of the Member’s registration, as confirmed to the Member by email, and is valid for an indefinite term.
9. A reward obtained through Marguerite, hereinafter referred to as a “Reward,” includes, but is not limited to, any benefit, cash back in Avril Dollars, special access or status, discount on eligible products or on a group of eligible products, discount on the subtotal of the Member’s bill, free products, or any other reward from Avril Supermarché Santé partners that the Member may obtain, earn or redeem following one or more Transactions.
10. Avril Supermarché Santé may, subject to applicable consumer protection legislation, terminate this agreement by notifying the Member in accordance with clauses 14 and 18 of this agreement.
11. The Member may terminate this agreement at any time and at their discretion by sending written notice to Avril Supermarché Santé at the email address indicated in clause 1.
General
12. Marguerite is the property of Avril Supermarché Santé and is offered to Avril Supermarché Santé customers in partnership with all Avril stores.
13. Avril Supermarché Santé may, subject to applicable consumer protection legislation, change all or part of the rules, terms, and conditions of Marguerite, its Rewards, its membership conditions, or the fixed ratio applied for the awarding and use of Avril Dollars or Rewards at any time by giving written notice to Marguerite Members 60 to 90 days before the change takes effect. A Member’s continued membership in Marguerite after changes have been made constitutes acceptance of such changes. If a Member disagrees with a change, the Member may opt out of Marguerite by calling Avril Supermarché Santé Customer Service at 1-844-375-6446.
14. Avril Supermarché Santé may suspend Marguerite by giving written notice to Marguerite Members 60 to 90 days before the suspension takes effect. Avril Supermarché Santé may also terminate Marguerite and this agreement at any time by giving written notice to Marguerite Members at least 60 days before the termination takes effect. At its sole discretion, Avril Supermarché Santé will give Members a period of time to redeem their Avril Dollars, but Members will not be able to earn any more Avril Dollars or claim any other monetary compensation for their remaining Avril Dollars as of the Marguerite termination date.
15. Marguerite membership is open to all residents of Canada aged 14 and over. Eligible persons become Marguerite Members upon registration.
16. BY ELECTRONICALLY ACCEPTING THIS AGREEMENT, THE MEMBER ACKNOWLEDGES HAVING READ AND ACCEPTED ALL MARGUERITE RULES, TERMS, AND CONDITIONS.
17. Avril Supermarché Santé makes every effort to ensure that the information displayed on the screens of the Marguerite mobile app and on the pages of the Avril.ca website is current, complete, and free of errors and inaccuracies. Despite Avril Supermarché Santé’s efforts and attention, errors may appear on certain screens of the Marguerite mobile app or pages of the Avril.ca website.
18. Any misuse or fraudulent use of Marguerite may result in the closure of the Member’s account, the disqualification of the Member, and the cancellation of their Rewards. This includes, but is not limited to, failure to comply with the obligations set out in this agreement, the sale or exchange of Rewards, the misrepresentation of facts relating to Rewards, and any other improper conduct, harassment of or inappropriate behaviour toward Avril Supermarché Santé or store staff, and any refusal to follow the instructions of such staff. In such cases, Avril Supermarché Santé reserves the right to terminate the Member’s Marguerite membership, withdraw or cancel their Marguerite card, cancel any Rewards earned, take legal action, and recover any damages and legal costs incurred.
19. This agreement is governed by the laws of the province of Quebec and the applicable laws of Canada. Any dispute between the parties arising out of this agreement will be dealt with exclusively in the courts of the province of Quebec.
Marguerite membership
20. Avril Supermarché Santé customers who wish to participate in Marguerite must become Marguerite Members. Marguerite membership is free. To join Marguerite, customers must download the free Marguerite mobile app from Apple’s App Store, Google Play or the Avril.ca website, use it to create an account, fill in the required fields, and check the boxes provided to indicate acceptance of these terms and conditions and the Policy.
21. To become a Marguerite member, the applicant must provide a valid email address, as this field is mandatory when creating an account. However, Members can, at their sole discretion, choose whether or not to receive promotional communications from Avril Supermarché Santé and its affiliated partners. To make this choice, Members can change their communication preferences in their account at any time. Members understand that if they choose not to receive communications from Marguerite, they may be excluded from certain Marguerite benefits or Rewards at Avril Supermarché Santé’s sole discretion.
22. Members of the former Avril Rewards program must also download the Marguerite mobile app and, if they had an Avril Rewards card, enter their physical or virtual card number and confirm their email address.
23. Companies and legal entities cannot become Members.
24. Only one person can be listed on each Marguerite account, and that person must use their legal name. Marguerite membership is non-transferable.
25. Only one virtual card is issued per Member. Each Member has a unique card number. Members may not share their account with anyone else and must keep their personal details and account password confidential and not disclose this information to anyone else.
26. No retroactive credit will be given for purchases made by Members before their Marguerite membership application was duly completed.
27. Marguerite membership is also open to employees of Avril Supermarché Santé and its stores.
28. Members may participate in Marguerite promotional contests, with the exception of employees and representatives of Avril Supermarché Santé, and subject to any restrictions imposed by law. Members are solely responsible for having or obtaining an IT device that allows them to participate in Marguerite. For technical assistance, Members can call Avril Supermarché Santé Customer Service at 1 (844) 375 6446, but Avril Supermarché Santé makes no warranty and assumes no obligation to resolve problems with the IT devices of Members.
29. The Member is solely responsible for having or obtaining adequate computer equipment to access Marguerite. In the event of technical difficulties, the Member may call Avril Supermarché Santé's Customer Service at 1 (844) 375-6446, but Avril Supermarché Santé offers no guarantee and undertakes no obligation whatsoever to resolve the Member's computer equipment problems.
30. Avril Supermarché Santé will not be liable in any way for service interruptions due to the characteristics and limitations of an Internet network, in particular in the event of access network interruptions, technical performance issues, and slow response times when consulting digital content in the Marguerite mobile app or on the Avril.ca website.
31. Due to the inherent characteristics of the Internet, Avril Supermarché Santé makes no warranty against the risks of web jacking, intrusion, or the contamination or theft of data, files, and programs. Members are responsible for taking all reasonable steps to protect their data, files, and programs against viruses and other threats.
32. If their mobile device is lost or stolen, Members must immediately call Avril Supermarché Santé Customer Service at 1 (844) 375-6446 to reset their password. In the event of suspected fraud, Members must immediately notify Avril Supermarché Santé using the contact form available at avril.ca/contact-us or by calling Avril Supermarché Santé Customer Service at 1 (844) 375-6446. Any unused balance of Avril Dollars or Rewards earned will remain unchanged. Avril Supermarché Santé will cancel any Avril Dollars or Rewards earned in an account that it suspects has fraudulently earned Avril Dollars or Rewards.
33.. Members are responsible for ensuring that the information in their account is current and complete and for updating their account as necessary by changing the information in the relevant fields in the Marguerite mobile app or on the Avril.ca website. Avril Supermarché Santé cannot be held liable for any errors or omissions related to inaccurate information contained in Member accounts.
34. The digital content in the Marguerite mobile app and on the Avril.ca website, as well as all elements reproduced therein (including texts, comments, illustrations, logos, and graphics) are subject to copyright as defined in the Copyright Act. Avril Supermarché Santé reserves the right to take all necessary action if any of these copyrights are infringed, and any such infringement by a Member will also be considered a breach of this agreement.
Earning Avril Dollars
35. Members can earn Avril Dollars on eligible products only (after any discounts and before taxes), including, but not limited to, products sold at Avril Supermarché Santé stores and on the Avril.ca website. Avril Dollars cannot be earned on gift card purchases or on shipping or transaction fees for online orders. Avril Supermarché Santé reserves the right to change the list of eligible products without notice.
36. Members earn 1% cash back in Avril Dollars (after any discounts and before taxes) on eligible products purchased at Avril Supermarché Santé stores and on the Avril.ca website. Members earn 2% cash back in Avril Dollars on eligible Avril Sélectionné, Avril Cultivé, and Avril Cuisiné products.
37. Members must present their virtual card before completing their payment in order to earn Avril Dollars on their purchases.
38. Earned Avril Dollars appear in Member accounts in the Marguerite mobile app within 24 hours of eligible Transactions.
39. Members can also earn extra Avril Dollars by completing actions determined by Avril Supermarché Santé, such as filling out their profiles. Members can view the list of eligible activities at any time via the Marguerite mobile app.
40. Marguerite Members may receive special offers to earn extra Avril Dollars when they buy certain products or combinations of products selected by Avril Supermarché Santé.
Redeeming Avril Dollars
41. Members can redeem Avril Dollars for all or part of their eligible purchases at Avril Supermarché Santé stores and on the Avril.ca website.
42. Avril Dollars have the following value: one Avril Dollar is worth one Canadian dollar.
43. Members need to have filled in all the mandatory fields in their account in order to redeem their Avril Dollars. Members can only redeem Avril Dollars for eligible products, including, but not limited to, products sold at Avril Supermarché Santé stores and on the Avril.ca website. Avril Supermarché Santé reserves the right to change the list of eligible products without notice.
44. Avril Dollars are considered a form of payment. As such, taxes are calculated before Avril Dollars are used.
45. Avril Supermarché Santé may, subject to applicable consumer protection legislation, change the minimum number of Avril Dollars to be used at any time by giving written notice to Marguerite Members 60 to 90 days before the change takes effect. Avril Dollars cannot be redeemed for the same Transaction in which they are earned. Avril Supermarché Santé may set restrictions on the use of Avril Dollars per Transaction. If the systems required to manage Avril Dollars are disrupted or unavailable, the use of Avril Dollars may be suspended without compensation.
Rewards
46. Members need to have filled in all the mandatory fields in their account in order to claim their Rewards.
47. Each Reward has its own specific terms and conditions of use and validity. Members should refer to the legal notices in each Reward communication piece for the terms and conditions applicable to that Reward.
48. A Reward may not, under any circumstances and for any reason, be transferred, refunded or exchanged with another Member or for money or any other Reward, whether similar in nature or not.
49. Marguerite Members may receive personalized offers from time to time based on their purchase history, preferences, and profile. Any personalized offer is non-transferable and is only valid for the account of the Member to whom it is offered.
50. By using a Reward, Members release Avril Supermarché Santé from all liabilities and claims relating to the redemption and use of the Reward and for any loss or damage caused by third-party products or services offered as a Reward.
51. Avril Supermarché Santé will not be liable in any way for Rewards awarded by anyone following the loss or theft of a virtual card if the Member concerned has not previously reported the incident (see the reporting procedure above). The Member will assume full responsibility for any Reward used prior to reporting the incident.
Marguerites
52. Marguerite allows Members to incrementally earn a Marguerite every time they buy products in an eligible category. Each Marguerite is associated with an amount in Canadian dollars that Members must spend in a given section at any Avril Supermarché Santé store. How quickly Members progress toward earning a Marguerite depends on how much they spend on eligible products in each Transaction (after any discounts and before taxes).
53. Members receive cash back in Avril Dollars when they earn a Marguerite. This table shows the details for each Marguerite:

54. When a Member reaches the total spend amount in Canadian dollars for a Marguerite, the counter for that Marguerite is reset to zero and the Member can start earning another Marguerite.
55. Members understand and accept that the Rewards offered under Marguerite may vary from Member to Member, both in number and value, depending on the number of Marguerites collected.
Closure of inactive accounts
56. Avril Dollars do not have an expiry date. However, if a Member’s account is inactive for 24 consecutive months, the Member’s status will be changed to inactive, and all Avril Dollars and Rewards earned in that account will be cancelled. At least 30 days but not more than 60 days before the Avril Dollars and Rewards are due to be cancelled, Avril Supermarché Santé will send the Member a notice of inactivity specifically stating that their inactivity will result in the cancellation of their Avril Dollars and Rewards and specifying the cancellation date. To maintain active status and Marguerite membership, Members must earn or use Avril Dollars or use a Reward at least once every 24 months or otherwise participate in Marguerite activities.
57. If a Member dies and Avril Supermarché Santé Customer Service is notified, the Member’s account will be closed and any Avril Dollars earned in that account will be cancelled. If no notification is received, the account will be closed and the Avril Dollars and Rewards will be reset to zero after 24 consecutive months of inactivity.
Privacy and information
58. Avril Supermarché Santé will keep all personal information collected from Members confidential and secure as per the Policy.
59. Members can find information about the Rewards available to them in the Marguerite mobile app and on the Avril.ca website. Once logged into their account, Members can view their profile information, the Avril Dollars they’ve earned, and the other Rewards to which they’re entitled, among other things.
60. Marguerite Members may review the personal information held in their file, dispute its accuracy, and correct any inaccurate information. Members must call Avril Supermarché Santé Customer Service at 1 (844)-375-6446 to view their file.
61. If a Member voluntarily opts out of Marguerite, any unused Avril Dollars and Rewards will be cancelled and the Member’s personal information will be deleted.
Post-visit survey
62. Members may receive an invitation by email or via the Marguerite mobile app to participate in Avril Supermarché Santé’s customer satisfaction survey. The official survey rules, terms, and conditions can be found at: satisfaction survey rules
